Casus
Markcx, een ongehuwde moeder, beklaagde zich erover dat de Belgische wetgeving voor het ontstaan van familierechtelijke betrekkingen tussen haar en haar dochter een erkenning eiste. Verder ontstond door die erkenning geen familierechtelijke betrekking tussen de verwanten van de moeder en het kind en werd in het Belgische erfrecht naar de mening van de moeder ongerechtvaardigd onderscheid gemaakt tussen kinderen die wel en kinderen die niet in familierechtelijke betrekking staan tot een ouder.
EHRM
De klachten zijn gegrond. Het Belgische recht is op deze punten niet in overeenstemming met artikel 8 EVRM, onder andere omdat de erkenning door de moeder een ontoelaatbare belemmering voor de normale ontwikkeling van het gezinsleven vormt.
Het in het Belgische erfrecht gemaakte onderscheid tussen kinderen is in strijd met artikel 8 jo. 14 EVRM.
Kortom, het onderscheid tussen een wettig en natuurlijk kind en tussen een gehuwde en ongehuwde moeder worden door het EHRM als discriminatoir aangemerkt.
N.B. Het EHRM hanteert in deze zaak een zgn. ‘dynamische interpretatie’ (het EVRM is een ‘living instrument’) en legt Staten naast negatieve of onthoudingsverplichtingen ook positieve verplichtingen op.
